The Public Prosecutor’s Office presented the accusation yesterday in the Fifth Justice of the Peace of San Salvador, who will notify the charges to the official and will have to defend himself as a citizen.

The director of the National Civil Police, commissioner Mauricio Arriaza Chicas was charged yesterday in a criminal court with a trial for the crime of breach of duty, for failing to press the Minister of Finance, Alejandro Zelaya, to the commission that investigated the handling of use of public funds for the pandemic, of being found guilty could be sentenced to four years in prison.

The Attorney General’s Office presented the accusation yesterday afternoon before the Fifth Justice of the Peace of San Salvador, which will have to notify the director of the PNC in the coming days and the defendant will have to appoint his defenders to face the process judicial. One of the prosecutors who filed the accusation assuring that Arriaza Chicas, as director of the National Civil Police, committed the crime of breach of duty provided for and sanctioned in article 321 of the Penal Code to the detriment of the public administration .

“Since the director of the police has no jurisdiction, we have presented the fiscal requirement as required by the Constitution and secondary laws,” he explained.

The prosecutor was emphatic in stating that the indictment has nothing to do with the previous trial that took place in Arriaza Chicas, which he said ended with the resignation of the Deputy Minister of Security.

“The duty of the Office of the Public Prosecutor is to fulfill the work ordered to us by the Constitution as well as to all the civil servants of the Republic, and this is a duty that is based on the Constitution, a duty derived from the Constitution, an obligation that the director has of the Police, ”he said.

According to different lawyers, in the pre-trial process that followed Arriaza Chicas, he may have committed new crimes; however, the Attorney General’s Office reported yesterday that he was only being prosecuted for disobedience of duties. Other crimes that would have committed is the usurpation of functions, since they appear to the prejudice pretending like vice-minister of Security, charging that a day before had resigned.

Sentenced to four years in prison for disobeying

The offense for which Arriaza Chicas is charged has a sentence of four to six years in prison and disqualification from exercising his charge if found guilty. The prosecutor claims that the disqualification for the operation would be for the same time as convicted sea, if found guilty.
