The contest for the mayor of Guánica could gain some clarity on Monday, when the State Election Commission (EEC) examines the proceedings of the event and awards, in compliance with a ruling by Judge Anthony Cuevas Ramos, certain votes to in favor of independent candidate Edgardo Creu Vélez.

The EEC has awarded Rodríguez Ramos 2,386 votes with 100% of the schools counted. Meanwhile, not a single vote in favor of Creu Vélez is reflected on the agency’s website, although 2,362 appear in the ballot box by direct nomination.

In recent days, on Thursday Cuevas Ramos decided that any vote that may be related to the figure of Cruz Vélez, including different variants of his name, will have to be awarded in his favor even if the voter did not make a mark on the box. which appeared on the ballot. However, he stated that a request from Creu Vélez to subtract from the other candidates votes awarded in the mixed category did not apply.

Creu Vélez argued that awarding these votes clashes with the text of the new Electoral Law, but the magistrate decided that this controversy is not part of an EEC resolution that Creu Vélez wanted to challenge in court.

“In the present case we must take off from a textual interpretation so that the intention of the voter prevails. The vote by direct nomination is distinguishable from the other types of voting because it requires, by its emission, that the voter writes the name of “A person who is not a candidate. The essence of this type of vote is the name of the nominee, so its validity can not be subject to whether it has a mark next to it,” said Cuevas Ramos in his sentence.

However, Merle Feliciano indicated that Rodriguez Ramos will have to be certified soon as mayor of Guánica.

“After the acts of the 14 units of the precinct 48 of Guánica are verified, because it is not a count, the amount of these votes (awarded to Creu Vélez) will not make a difference in the final result. “It has been a mistake to point out that the 2,362 correspond to Edgardo Cruz and that was not what the EEC certified,” Merle Feliciano told El Nou Dia. “On Monday we will be coordinating to verify the proceedings,” he added.
