Tokyo Drift, part 2
It took almost three years, but my two original Joy-Con sets have started to drift: it’s time to let them graze. It seems that controllers take so long to malfunction, as Nintendo has been the subject of multiple class action lawsuits in recent years; some of which really started shortly after the release.
Now we can add another one to this stack. Filed on January 15 this year, Canadian law firm Lambert Avocat Inc. is currently seeking to file this class action in a Quebec superior court.
Here is the main argument presented by the company:
“In November 2017, our customer bought a Nintendo Switch gaming system. After 11 months of using it, he noticed that his left Joy-Con ™ controller was defective. His character would move in a direction without his input, a problem known as Joy-Con Drift.Then he realized that the problem persisted in other games and when navigating the main menu.
Our customer contacted Nintendo and sent the left driver to the Nintendo factory for repair. However, two months after receiving it, he noticed the same problem with the right driver, then with the second pair of Joy-Con drivers he bought, as well as his Nintendo Switch Pro driver.
Our customer finds that this defect seriously compromises the basic function of the drivers and prevents them from using their gaming system properly. “
The company cites the act of consumer protection in its presentation, and notes that “the goods acquired must be suitable for the purposes for which such goods are normally used and must be durable in normal use for a reasonable period of time, taking into account its price and the conditions of use. “
If you remember, Nintendo has been asked about the situation on numerous occasions by journalists, fans and even investors – and has generally declined to comment, in part because of the ongoing nature of processes like this. It seems like time has passed for Nintendo – they’ll probably have to respond seriously on a corporate level sometime this year, beyond the current repair site.
