This was resolved by the Chamber and calls on TSE to take the necessary measures so that the New Ideas party replaces the candidacy that will be left empty.
The Constitutional Chamber of the Supreme Court of Justice (SCJ) issued a resolution on Tuesday admitting the existing unconstitutionality lawsuit and ordering as a precautionary measure to suspend the registration of the candidacy for deputy owner by the Legislative Assembly by Walter Araujo for the New Ideas party.
“The following precautionary measure shall be taken: (i) Suspend the effects of the object of control, so that the citizen Walter René Araujo Morales will not be able to run for the position of deputy owner of the Legislative Assembly for the territorial constituency of San Salvador or any other for the New Ideas party, another non-partisan political party or deputy, for the duration of this process, ”the House resolution says.
The Chamber also orders the TSE that the ballot papers be printed without any identifying data or image of Araujo, to prevent voters from making mistakes or confusion.

In addition, it orders the Court to take the necessary decisions and measures for the New Ideas party to replace, in accordance with the law, the candidacy that will be left vacant as a result of this resolution.
In paragraph two, the Chamber’s writ admitted the lawsuit filed against the applicant in order to determine that the resolution issued by the TSE on January 8, by which he registered Araujo as a candidate, violated Article 126 of the Constitution.
Faced with this, the Chamber stated “Because the TSE allegedly did not document or verify its notorious honesty, as among other things there would be an alleged pattern of aggressive and violent behavior against women in public spaces and social networks. “.
This resolution addresses an appeal filed by citizen Bertha DeLeon, lawyer and candidate of our Time for a council in San Salvador. She denounced Araujo for expressions of violence against women, and in this regard, there is a case open in the Specialized Chamber for a Life Free of Violence against Women.
In filing the appeal, DeLeon argued that enrolling Araujo as a candidate violated Articles 126, 127, and 128 of the Constitution of the Republic.

Plaintiff’s reaction
Upon learning of the resolution, lawyer De León expressed her satisfaction on her Twitter account, posted a video in which she emphasized that the resolution was a triumph in favor of women.
“This is a triumph for women! Encourage those who suffer violence or abuse to report it, to keep us in the system and not get tired of fighting,” she wrote in the post.
Division in the TSE
The inscription of Araujo had caused division inside the Court cause that its situation delayed the printing of ballots for the delegations by the department of San Salvador.
Magistrate Noel Orellana mentioned on Tuesday that there was concern on the part of TSE magistrates about the times of printing on the ballots, “some are of the criterion that ballots from San Salvador cannot be printed until Sala fails ( Araujo’s candidacy “.
This was confirmed on January 22, by magistrate Julio Olivera when he warned, “if the chamber does not resolve this appeal of unconstitutionality or any other appeal that may be filed, the ballots will not be printed and without ballots no there is an election in this country “.
