A married teacher accused of having sex with a 15-year-old student on three occasions told a UK court that, at 5 feet tall, it was “too low” to make it impossible.
The mother of three, Kandice Barber, 35, is accused of riding the boy in her vehicle, having sex in a field and having sex in the woods in 2018.
But her lawyer said she was so “small” that it only reached the teenager’s shoulder, making her alleged puzzles physically impossible, The Sun reported.
The student initially denied the affair, thinking he may have impregnated it, but later confessed that after Snapchat photos he sent her topless, they began spreading through Princes Risborough High School in Buckinghamshire. , a court known in September.
Barber has always denied the alleged links and claimed that the intimate images were hacked from his phone.
But researchers later found a series of seemingly incriminating searches on Google, including “alibis” and “lies about where you’ve been,” The Sun reported.
On Tuesday, the jury was informed that the woman had already been convicted of sending a message to the boy with a video in which she was having sex in bed, according to the media.
But his lawyer, Nadia Chbat, told the Amersham court that the alleged break-ins never took place.
“She told the police she was behind her. You’d pulled your clothes down, ”he told the 18-year-old.
“You didn’t even think it could reach your shoulders at that moment, did you? We just get it, that you then get out of the car and go to a small wooded area: this is where, you say, he gave you oral sex, ”he said.
“Why would you get out of the car? She is on top of you and having sex in the car. What was the need to get out of the car? “Chbat continued.
“Presumably it would have been just a matter of his body moving to the pants area? Instead, the decision was made to get out of the car and into the wooded area,” he said.
“You both walk into this wooded area and that’s when you adjust to the wooded area and say you had oral sex.”
The alleged victim told the court they had to get out of the vehicle because Barber had parked next to a busy road near his home in Buckinghamshire, The Sun reported.
Jurors also heard that Barber allegedly threatened to “overthrow the complainant” if he reported her.
“You can’t make me blush when I’m teaching now, poker-faced,” he allegedly texted her in class, the court reported, according to the media.
Barber has denied three charges of provoking or inciting a child under the age of 16 to engage in sexual intercourse and a charge of sexual communication with a child.
He also denied any charge of provoking or inciting a child to engage in sexual activities while in a position of trust, and another of causing a child to see a sexual act of a person in a position of trust.
