Apple is working on a deal with a fledgling pear-making company the pear logo it tried to ban for being too similar to its own famous emblem.
The Prepear logo – a pear with a leaf on top “easily recalls Apple’s famous Apple logo and creates a similar commercial impression,” the Silicon Valley giant said in a court hearing over the summer, and added that the similarities “would cause the ordinary consumer believes that” Prepear is “affiliated or approved by Apple.”
But in an application filed by MacRumors to the U.S. Patent and Trademark Office’s Board of Appeals and Trademark Appeals, Apple requested the stay of the proceedings for 30 days while “the parties are actively involved. in negotiations to resolve this matter “.
Super Healthy Kids, the company behind the Prepear app, which allows people to store recipes and create meal plans, had accused Apple of abusing its position of being able to look for small businesses like ours that they are already fighting because of the effects of Covid-19. “And he pledged to fight Apple ‘not just to keep our logo, but to send a message to big tech companies that harassing small businesses has consequences.”
The startup launched a Change.org campaign in August in hopes of getting Apple to withdraw. The petition has already garnered 269,000 signatures.
If the two parties do not reach an agreement, the dispute will resume on January 23, with the first court appearances scheduled for March.
Apple did not immediately respond to a request for comment.
