During an appearance on Fox News Sunday, Breyer expressed his openness to the deadline, but warned that it should be set for “a very long time.”
“I think this could be done. It should be a very long time because you don’t want the judge who keeps you to start thinking about your next job, ”said Breyer.
“But it would make my life easier,” he added, smiling.
Justice heeded calls from several Democratic lawmakers to step down from the bench, saying people “have a right to their opinion.”
Justice has not outlined plans to leave the court soon, but has said it does not believe it will remain in the bank until it dies.
Breyer during the interview also addressed the possibility of adding judges to the court, warning that making changes to the bench could end public confidence in the institution.
“Well, if one party could do it, I guess another party could do it. … It seems to me, you are starting to change all these things and people will lose confidence in the court, ”he said.
Breyer sounded a similar note in an interview with NPR published Friday when asked about remaking the Supreme Court, stating that “what happens is everything.”
“If Democrats can do it, Republicans can do it,” he added.
