New York Republican Claudia Tenney will be certified as the winner of the race to represent the 22nd district of the State Congress, according to a State Supreme Court ruling Friday.
The decision by State Supreme Court Judge Scott DelConte to order the counties and the state election board to certify their victory puts an end to a three-month legal battle with another chamber for Republicans, which reduced the democratic majority to 221-212. Tenney will dismiss First Term Representative Anthony Brindisi (D).
DelConte filed before local election boards for “systemic violations of state and federal election laws,” including the failure of Oneida County to process more than 2,400 election applications. However, the judge decided that it is not the task of the court to rectify these errors.
“All valid votes cast in the 22nd district of the New York Congress have been counted and accounted for,” DelConte wrote.
The judge also ruled that Brindisi failed to prove that certifying Tenney’s victory would cause “irreparable harm,” as he has other avenues to combat certification in the courts.
Brindisi has already said he could appeal against the ruling and also has the option of contesting election results directly in the House. He said there should be a count and an audit after what he said were “countless mistakes and discrepancies” in the initial count.
“I think a full audit and a manual count are the only way to solve this race. With such a thin margin, changing accounting and the countless mistakes that have occurred reaching today’s final issue, we can’t allow the luxury of asking us here, “” He said. “It’s shocking, right now, no one knows who won that race. My opponent and I deserve real clarity. “
Tenney leads Brindisi by 109 votes and has a 0.035% lead. He won the seat for the first time in 2016, but lost it against Brindisi in 2018, when Democrats had an electoral cycle. Her victory would bring the number of Republican women in the House to 30, a jump of just 13 after the 2018 interim periods.

The victory is particularly significant for the Republican Party at a time when the House is so tightly divided. Democrats have little room for error as the party appears to pass important laws, including President Biden’s $ 1.9 trillion coronavirus relief package.
The victory also leaves the GOP with five seats to regain a majority in 2022.
Tenney could face an uphill battle for re-election next year.
