The Court of Appeals overturned the ruling of the Court of First Instance of San Juan on the election for mayor of San Juan by the candidate for the Victory Citizen Movement (MVC), Manuel Natal Albelo, against the ‘mayor-elected Miguel Romero.
“We will be asking the Supreme Court of Puerto Rico to review and revoke the erroneous determination issued 2-1 by a panel of the Court of Appeals and, restore the well-founded determination of the Court of First Instance, thus rejecting the challenge of the election of San Juan “, Romero reacted on the other hand after knowing the determination and emphasizing that this one had been with a vote of 2-1.
According to the sentence Natal “gave him [a Romero] appropriate notification of the existence of an action against fashion which may appear to be of such interest. “
“We conclude that this notification not only satisfied the requirements of Article 10.15 of the Electoral Code, it also guaranteed the petitioners their due process of law in order to give them precise notification about the alleged and requested in the writ of appeal and the requirements of the primary court laid down in the Order of Sample Cause “, reads the 18-page document shared by the former representative.
“Now the case goes back to Court of First Instance so that all the irregularities of Unit 77 can finally be assessed,” reads a post on the politician’s Facebook account.
Natal had filed a lawsuit in the Court of First Instance of San Juan to challenge the votes of Unit 77 that gave the victory to Romero by the city council of that municipality.
“There are at least 6,593 municipal ballots in Unit 77 that are illegal and voters, chain of custody and provenance are impossible to determine,” read the appeal filed by the mayoral candidate for the MVC.
However his claim was dismissed for “having failed to comply with the jurisdictional term established by the Electoral Code of 2020 to summon the contested Candidate”. That is, Natal did not place the contested candidate within the five-day period established by the new Electoral Code.
