If a U.S. district judge in California accepts the request, it will be the fourth time the Holmes fraud process has been delayed.
Theranos Inc. founder Elizabeth Holmes is pregnant, her lawyers and the government reported in a court case requesting a six-week delay for her fraud trial, which was due to begin on July 13th.
“On March 2, 2021, the defendant’s attorney notified the government that the defendant is pregnant, with an expected expiration date of July 2021,” Holmes prosecutors and attorneys said in the filing of Friday. “In light of this development, it is not feasible to begin the trial on July 13, 2021, as currently scheduled.”
Both parties demanded that the trial begin on August 31.
If U.S. District Judge Edward Davila in San Jose, California, accepts the request, it would be the fourth time Holmes’ trial has been delayed. Initially, it was scheduled to start in July 2020 and was moved to October before being restored again in March, both delays due to the pandemic. Davila has repeatedly insisted that the trial begin, in the hope that conditions will improve enough once the population is vaccinated more.
Meanwhile, Holmes and prosecutors are in the midst of fighting for evidence that jurors will be able to see and hear. Davila’s decisions will shape the evidence, as well as the strategies of both parties on which arguments the lawyers will stress or will be forced to defend.
The case is U.S. v. Holmes, 18-cr-00258, U.S. District Court, Northern District of California (San Jose).
