“Niviane Petit Phelps, knowingly and intentionally, made threats to kill and cause bodily harm to the U.S. Vice President in violation of Title 18, Section 871 of the United States Code,” Feb. 13-18, according to the complaint.
On March 3, Special Agent David Ballenger was informed of a threat to kill Harris, according to the complaint. Phelps sent the threats to his imprisoned spouse at the Wakulla Correctional Institution via JPay, a computer application that allows media to be shared between non-jailed and jailed people.
A special Secret Service agent assigned to the case obtained the videos and photographs Phelps sent to his spouse.
“The videos (which are relevant to this investigation) generally show Phelps complaining and talking angrily in front of the camera about his hatred of President Joe Biden and Vice President Kamala Harris, among others,” the complaint said. “However, in these videos, Phelps also made statements about the assassination of Vice President Harris.”
In one of the videos, “Phelps stated,” Kamala Harris will die. Your days are numbered, “he said.
In another Feb. 18 video, Phelps stated, “I’m going to the gun zone. … I swear to God, today is your day you will die. 50 days from today, mark that day.”
Phelps was also shown on a shooting range in a photo dated two days later, according to the complaint. “On February 22, 2021, Phelps applied for a concealed gun permit.”
On March 3, the secret service and Miami-Dade police department detectives went to Phelps’ residence to try to interview her, but refused to speak to them at the time, according to the complaint.
“Two days later, I received a call from Phelps, who complained that his employer had put him on administrative leave,” the complaint said.
On March 6, a Secret Service agent went to talk to Phelps at his home.
