The Secretary of Justice appointed, Domingo Emanuelli Hernández, together with the Director of the Public Integrity and Affairs Division of the Comptroller, Wanda Cassià Sosa, announced a communication sent to the Office on the case against the former senator Eduardo Bathia Gautier.
Emanuelli Hernández indicated that, in the morning, a communication was sent to the members of the Panel in which the appointment of an Independent Special Prosecutor (FEI) by Bathia Gautier is not recommended, detailed in the case number 2020-31- 102-00043. Today, communication was also sent to him notifying this recommendation to the parties, plaintiff and plaintiff.
The complaint was filed on July 28, 2020 in the Department of Justice by Hon. Josep “Quiquito” Meléndez, representative of the House of Representatives. The lawsuit alleges that Bathia Gautier holds bonds from the Electric Power Authority (EEA) and the Urgent Interest Fund Corporation, known by its acronym COFINA, and that, despite this, while acting as President of the Senate, he incurred illicit enrichment and undue influence in promoting and approving Law 72-2015.
The complainant added that this legislation, among other things, increased the sales and use tax, thereby strengthening COFINA’s coffers. Situation that, in his opinion, entailed a patrimonial benefit for the graduate Bathia Gautier like bonista of this Corporation.
The preliminary investigation conducted by the staff of the Department of Public Integrity and Affairs of the comptroller of the Department revealed that no elements of crime arise that justify the appointment of an EIF.
