Luis Guzmán Racó, one of the 10 most wanted criminals in the United States, is arrested

A Mexican who is on the list of 10 most wanted undocumented criminals for more than a decade he was recently arrested in the Denver area by specialized federal agents, the Immigration and Customs Enforcement (ICE) Service reported Monday of the United States.

According to authorities, Luis Enrique Guzmán Racó, 29 years old, Resided in Aurora, east Denver, where he was confiscated on April 9 by uniformed officers from the ICE Immigration Law Enforcement and Detention Operations (ERO) group.

In 2012, Guzmán Racó had been found guilty by an Aparahoe county court of attempted murder on December 6, 2010 of a student in front of the Aurora Central School, which was attended by Guzmán.

The court also found him guilty of six charges related to the incident, including “extreme indifference to life,” and eventually the Mexican was sentenced to 35 years in prison.

The victim, Karina Vargas, then 16, she was paralyzed. Vargas, with no connection to his attacker, was shot in the back as he rested in front of the school and showed his friends his new pet.

According to the police report, Guzmán Racó intentionally shot from a moving act towards the students to earn a place in a gang operating in Denver and in mountain locations in western Colorado and fighting for “territory control” against another gang members used colors similar to the victim’s hair and that he had attacked Guzmán Racó a few months earlier, injuring his head.

In November 2015, the local court of appeals overturned the sentence against Guzmán Racó for lack of effective legal advice because, on learning of threats against the jury, the judge isolated the jury without consulting the defense. The Colorado Supreme Court later upheld this error.

Despite ICE’s order to detain him, he was released.

In September 2017, In his second trial for the 2010 attack, Guzmán Racó was convicted of attempted murder and sentenced to three years in prison, but was immediately released due to the time he had already been detained. Again, according to the ICE, the order to transfer him to the custody of the agency was not respected.

From that moment, Guzmán Racó was on the list of those most wanted by the ICE for being a convicted criminal and for being considered “a clear threat to Aurora’s public safety.”

Although Guzmán can no longer be tried again for the attack on Vargas, if he were convicted of all the charges still pending against his sentence he could reach 48 years in prison.
