Vice President Mike Pence wants nothing to do with Rep. Louie Gohmert (R-TX) ‘s latest offer to give him the power to overturn the 2020 election results. In a legal filing Thursday, Pence argued that the congressman’s lawsuit, which was filed with other Republicans against the vice president, should go to Congress. “Plaintiffs have filed an emergency motion in this court that raises a number of important legal issues about how electoral votes should be counted for the president,” the Pence file says. “But the lawsuit of these plaintiffs is not a suitable vehicle to solve these problems because the plaintiffs have sued the wrong defendant.” “A lawsuit to establish that the vice president has discretion over the count, filed against the vice president, is a legal contradiction,” the document adds. Gohmert’s lawsuit alleges that a 100-year-old law dictating the Electoral College process is unconstitutional and Pence should be able to determine which electoral votes will be counted.
