The Biden administration said Wednesday it still needs more time to determine how it plans to handle the House Democrats’ request. In a court case, Justice Department (DOJ) lawyers said incoming leaders in the department and the Treasury Department “have been assessing and discussing” their position.
“Because the transition to new leadership in both agencies is still ongoing, defendants require additional time to complete this process,” DOJ attorneys wrote.
The administration requested that the parties to the lawsuit for the House Democrats’ request file another state report on April 2.
DOJ lawyers said they would not oppose Judge Trevor McFadden, a Trump-appointed federal district judge in Washington, who extended his order until April 2 requiring the Treasury to give personal lawyers of Trump a 72-hour notice before filing the former president’s tax returns on the House Roads and Media Committee.
Trump’s attorneys testified in court on Wednesday that they agreed with the DOJ’s approach.
Lawyers for the Forms and Means Committee said any additional time allowed to the administration to determine its position “should be limited, given the time the Committee’s request has been hampered.”
McFadden scheduled a teleconference on the case on April 1 in light of the group’s concerns. He extended his order 72 hours in advance to that date and asked the parties to the lawsuit to file a status report by March 31st.

In 2019 he applied to the IRS for six years of Trump’s personal and business tax returns. Treasury and the IRS rejected the request, prompting the committee to file a lawsuit against the agencies. Trump is also involved in the case in a personal capacity.
The Biden administration could choose to take a different approach to the request of House Democrats and provide them with Trump’s tax returns. So far, the administration has been cautious in examining the issue, as it is working to occupy key positions in Treasury and DOJ.
