The scandal sparked by the case of Operation Falcon will transfer ordinary jurisdiction when the Public Ministry requests today, Monday, the Supreme Court of Justice the appointment of a special investigating judge to investigate the links of legislators with the case of drug trafficking and money laundering that has shaken Dominican society.
The request for the appointment of a judge of special instruction will be requested by the director of Persecution, Yeni Berenice Reynoso, for the control of the investigations of the legislators, between which appear the deputies Héctor Darío Feliz and Nelson Marmolejos Gil.
Berenice Reynoso reported that the request will be made under the privileged jurisdiction enjoyed by congressmen, and this will not prevent them from being prosecuted, and as soon as possible the names of the legislators involved will be made known to society.
The name Marmolejos Gil is included in the file of Operation Falcon on drug trafficking and money laundering, after the Public Ministry stated that it obtained full funding for its campaign with the money from the chapter of the organized crime structure operating in Santiago and other areas of the country.
The name of the deputy Darío Feliç is for having transported one of the people who will be extradited to the United States, linked to Operation Falcón, and who had the presumed intention “to remove the extraditable from the investigation”, according to the prosecutors of the case.
With this, there are already two judges of the Supreme Court of Justice who will have to have control of the investigations against legislators, for money laundering, products of drug trafficking. The first was that of the deputy Rosa Amalia Pilarte López, for her link to an alleged network headed by her husband, Miguel Arturo López Florencio (Micky López).
Berenice Reynoso maintained that they have a solid and armored file, with thousands of pages with which they will obtain measure of coercion against the inserts.
He assured that there is sufficient evidence to show the involvement of the accused in the international network of drug trafficking and money laundering.
“In this process, and have been the guidelines followed by the Public Ministry, under the instruction of Magistrate Miriam Germán, anyone who has responsibility, who is accredited with evidence, will be prosecuted and prosecuted,” said the deputy attorney general.
Deferred coercion measure
The judge of the Court of Permanent Attention of Santiago, Iris Borges, postponed for next Friday, at 10:00 in the morning, the knowledge of the request of preventive imprisonment of 18 months presented against the 21 involved of the criminal network.
Since 2017
The criminal organization that included the extradilables, the defendants in the investigation, and others in this process, trafficked about 2,500 kilos of cocaine per week since 2012, but their operations have been recorded by intelligence agencies since previous years and there is evidence that they increased from 2017 onwards.
Approximately 8,500 kilos of cocaine were confiscated between the Dominican Republic and Puerto Rico, which shows the climate of impunity under which they carried out their criminal operations.
Finjus is worried
For his part, the Vice President of the Institutionality and Justice Foundation (FINJUS), Servi Tul·li Castaño Guzmán, considered that Operation Falcon represents a new test for the democratic political system of the Dominican Republic.
He understands that the case shows the serious shortcomings of the national legal and institutional system and indicates how deep are the weaknesses that persist in the country.
“Because in all sectors there is the conviction that the penetration of organized crime in the ranks of power is much higher than perceived and that the enigmatic formulas of international organizations are short to calculate the harm that these phenomena produce in our economy and social structure “, the jurist has delimited.
In his view, the operation is “another sign that the state, in its main institutions, needs a deep moral and legal reengineering, which must begin with the strengthening of the bases of consequences system. .. “
