They postpone for Friday knowledge of coercion measure to expelotero Joan Encarnació

The Permanent Attention Court of the National District postponed for next Friday, September 3, the hearing of knowledge of coercive measure to the ex-pilot Joan Encarnació Santiago, accused of sexual assault against a minor daughter.

Judge Pablo Imbert made the decision after accepting the request of the new legal representative of the defendant, who joined the process on Tuesday and asks for a timely deadline to know the file prepared by the Unit of Prevention and Persecution of Gender, Intrafamily and Sexual Violence in the National District.

The former Major League player has been detained at the Ciutat Nova Courthouse since last weekend, following a complaint lodged by the girl’s mother.

Upon leaving the hearing, the prosecutor in charge of the National District, Rosalba Ramos, has indicated that the Public Ministry is ready to hear the hearing, but abides by the court’s decision.

The prosecutor has reiterated that the coercive measure requested by the prosecution body is one year in pretrial detention, as the defendant does not offer guarantees to appear at the proceedings and submit to them.

According to the coercion measure application file, Encarnació committed the act last May.

The accusing body has granted this fact the legal qualification of violation of articles 332-1 and 332-2 of the Dominican Penal Code and article 396, literal bic, of Law 136-03, of the Code for the System of Protection and Fundamental Rights of Children and Adolescents.
