(Reuters) – Apple CEO Tim Tim, chief software officer Craig Federighi and other executives were named on a provisional list of witnesses in the case of the software giant against Epic Games, a lawsuit was filed on May 19. March.

App Store vice president Matt Fischer and Apple colleague Phil Schiller were also named on the list presented to the Northern District of Oakland’s Northern California Division, a copy of which is saw a copy.

The iPhone maker has had problems with Epic Games, the creator of the popular game Fortnite, which last year tried to avoid a 30% fee that Apple charges developers in the App Store by launching its own payment system in the application. The move led to Apple banning Fortnite from its store.

In a separate court case, Epic Games included its founder and CEO Tim Sweeney among its own witnesses to the case.

Apple did not immediately respond to a request for comment from Reuters, but told Bloomberg in a statement that it was “confident that the case will show that Epic deliberately breached its agreement solely to increase its revenue.”

A direct message to Epic Games on one of its official Twitter managers did not get an immediate response.
