The Court of First Instance, through Superior Judge Anthony Cuevas Ramos, this afternoon rejected the lawsuit filed by the former candidate for mayor of San Juan, Manuel Natal, in which he sought to challenge the election of Miguel Romero as mayor by the existence of alleged irregularities.
According to the Court’s ruling, the lawsuit is dismissed “for failing to comply with the jurisdictional term established by the Electoral Code of 2020 to place the contested Candidate.”
In other words, Natal did not place the contested candidate within the five-day period established by the new Electoral Code.
“We recognize that we are facing a new issue, but in spite of all the above, and if it is understood that our interpretation of the terms of the Electoral Code for the year 2020 is very restrictive and that these terms must be considered as strict compliance that are non-extendable, the Petitioner did not comply with these requirements either, “the judgment reads.
On January 21, Romero filed a Motion to Dismiss for Lack of Jurisdiction over the Person. In his writing Romero Lugo was limited to arguing about the lack of jurisdiction over the person for not having been located as required by the Electoral Code.
Natal argued that there are a greater number of ballots awarded than the number of people who in fact validly voted in Unit 77 of San Juan and called for an order to hold a new election for mayor of San Juan John only in Unit 77 which he says is justified by the alleged irregularities.
