The trial against fraud by former Theranos CEO Elizabeth Holmes came to a complete halt when a jury revealed to the court that it had been potentially exposed to Covid and that it was awaiting the results of the evidence.
At an emergency Zoom hearing on Thursday afternoon, U.S. District Court Judge Edward Davila told Holmes’ attorneys and the government that he had received an email from jury number 9 on Thursday indicating that he could have been exposed during the holiday weekend, but showing no symptoms.
“It’s a bit, I don’t mean nefarious, but I’m worried that before we finish the first witness we have a problem,” Davila said. “For our own good, there’s still a high number across the county and we hope everyone stays safe.”
The government, however, backed down and expressed concern over the delay in the trial given the number of witnesses it plans to call. U.S. Deputy Attorney General Jeff Schenk told the judge that the jury was vaccinated, that he currently had no symptoms, and that it was unclear if he had had close contact with Covid-19.
“I think at the stage we’re at it would be safe to proceed with the trial tomorrow, but I understand that the court could determine, especially at first, to be a little safer and be very careful,” Schenk said.
He later added: “I think we’re a little worried about the total number of witnesses we want to call in the coming months in this trial. But I can’t tell the court that tomorrow will be what makes the difference. That’s not the challenge. “.
The expected trial began Wednesday with opening statements. Preventive measures were displayed in the courtroom full of San Jose courts with plexiglass panels in front of the judge, at the end of the jury room and where lawyers speak. The room has also installed numerous air purifiers and an improved filtration system.
Holmes faces a dozen charges of fraud and conspiracy. She has pleaded not guilty.
